Adopts the Law "On Investment Contract"

On 19 March 2013, the President of Tajikistan signed the Law “On Investment Contract”. The Law governs contracts between the Government of Tajikistan and investors (both domestic and foreign) for investment projects of a “strategic” character and in priority sectors of the economy. Such contracts are to be approved by the Government of the Republic of Tajikistan and ratified by the Parliament. The Law establishes a special legal regime for such contracts. For example, a contract may contain rules which are not provided for under the legislation of Tajikistan, grant special tax benefits, include a stabilization clause and contain other protections and guarantees for investors. The Law allows the possibility for the parties to agree on an arbitration clause covering all disputes arising out of the contract. Tajikistan can waive its sovereign immunity including immunity against enforcement of arbitral awards.
