Regulates land holdings by foreign enterprises

Land Regulation No. 21 of 2011 provides the procedure for regulating the holding of land by foreign enterprises. In this respect, it provides that an application for allocation of land by a foreign enterprise must be lodged with the relevant allocating authority and an application to hold title to land held under a lease by a foreign enterprise must be made to the Commissioner. Upon receipt of such an application, the allocating authority or the Commissioner, as the case may be, refers the application to the Minister. The Minister, upon receipt of such an application, seeks a written recommendation or advice of the Minister responsible for trade or any other relevant Minister for purposes of an investment involved, in order to determine whether the nature of the investment to be undertaken by such a foreign enterprise qualifies the enterprise to hold land. The Minister, upon receipt of the recommendation or advice under this Regulation and where the Minister is satisfied that the foreign enterprise qualifies to hold land gives a written approval for allocation or holding of land by the foreign enterprise.
