Adopts new PPP law

The Parliament adopted a new law on PPP, replacing a previous PPP-Law of 2010. The new Law stipulates, inter alia, more flexible terms for determining the technical and economic indicators of the project; it provides both partners with more options to finance their investments; and it limits the possibility for unilateral termination/modification of the project by the public partner. Romanian law and jurisdiction are mandatory in all PPP projects and arbitration is allowed for the interpretation, entering into, execution, amendment and termination of the PPP contracts. The contract award is subject to domestic courts. The Law entered into force on 25 December 2016.
