Amends the National Security Review of Investments Regulations

On 2 August 2022, the Regulations Amending the National Security Review of Investments Regulations came into force. These Regulations provide an option for non-Canadian investors to obtain pre-implementation regulatory certainty with respect to a national security review of investment that do not require a filing under the Investment Canada Act (ICA). Where a voluntary filing is submitted, non-Canadian investors will benefit from a shorter period of 45 days (as compared to five years) during which the Canadian Government must initiate a national security review.

The voluntary filing allows investors to gain regulatory certainty prior to implementation.
