New regulations on foreign entities' access to land

On November 5th, 2020, the Official Gazette (Vol. XL No. 80) published the "Non-Citizens Land Holding Regulation (Amendment) Act, 2020".

In Antigua and Barbuda, since 1968, a law limits access to land for non-citizens and foreign entities. These limitations can be waived through licences. This amendment extends the need for a licence to all beneficiaries of non-citizen entities holding land in the country, and to members of companies having no share capital. A licence allowing non-citizens and foreign companies to become mortgagees is created, increasing the scope of possible financial activities for foreigners in Antigua and Barbuda. Licences are now open to trustees and to anyone deemed relevant by the authorities. The prices of licences are now more detailed, and they are generally higher than in 2018. The responsibility of granting licences is given back to the Governor-General who acts on the advice of the Cabinet.
