Expands the FDI screening regime to encompass investors from the EU

On 31 May 2023, the Parliament of Romania passed Law No.164 introducing additional changes to the foreign direct investment (FDI) screening regime. The key revisions include the expansion of mandatory filing obligations to encompass investors from the European Union. Moreover, the law also clarifies the authorities' powers to unwind transactions that breach FDI rules, with the final decision resting with the Government. The Romanian Competition Council will issue secondary rules on how the investment value should be determined. The changes came into effect on 10 June 2023.
