Broadens scope of investment screening

On 14 June 2023, the Danish Parliament passed Law No. 736 broadening the scope of the Investment Screening Act and modifying the application process.

Under the updated process, FDI applications will undergo a two-phase review. Phase 1 involves a pre-authorization assessment to determine eligibility under the Act. If the initial application or notification cannot be authorized or approved, a phase 2 screening exercise will be initiated, during which the Danish Business Authority may request additional information. The amendments also require authorization for contracts related to the establishment, co-ownership, and operation of the North Sea energy island.

These new amendments took effect on 1 July 2023.
