Issues Decree-Law No. 2022-68 for improving the effectiveness of PPPs and promoting investment in priority sectors

On 19 October 2022, Tunisia adopted Decree-Law No. 2022-68 issuing special provisions for improving the effectiveness of the implementation of public and private projects. The new decree-law provides for encouragement of private investment, inter alia, incentive of projects carried out under public-private partnerships and projects in the field of renewable energy, stimulation of investment in the agriculture, industrial, infrastructure development, technology and logistics sectors, stimulation of investment in the housing and real estate sectors.

Further, the Decree-law contains, also, special provisions for the acceleration of the production of public investments by reducing the deadlines for the implementation of public projects, encouraging Tunisian companies and start-ups by granting certain priorities to national companies and developing the effectiveness of the public procurement system.

Finally, the Decree-law creates the position of the Investment Ombudsman under the Minister for Investment. The Investment Ombudsman is responsible for the mediation mission before the phase of taking legal action between investors and public bodies in order to resolve problems and conflicts that may arise between them. The powers of the Investment Ombudsman and the rules for the exercise of his functions are set by decree.
