Strengthens protection of sensitive personal data

On 12 February 2024, the President of the United States issued the Executive Order to Protect Americans’ Sensitive Personal Data. It authorizes the Attorney General to halt the large-scale transfer of personal data to certain countries and imposes safeguards to prevent unauthorized access to sensitive information on citizens of the United States. The protected data include genomic data, biometric data, personal health data, geolocation data, financial data, and certain kinds of personally identifiable information. The Order recognizes that the sale and transfer of sensitive personal data pose significant risks for privacy, counterintelligence, blackmail, and other national security concerns. The new legislation also has an investment component — the Departments of Justice and Homeland Security are instructed to set high standards to protect access to citizens' data from countries of concern via any commercial means, including investment, vendor, and employment relationships.
