Launches plan to tighten foreign investment rules in agricultural land

On 8 July 2025, the Government of the United States of America, through the Department of Agriculture, released the National Farm Security Action Plan, which elevates agriculture within the national security agenda. The plan outlines administrative steps and proposed future actions, including:

  • Seeking legislative or executive measures to prohibit new acquisitions of, and terminate direct or indirect control over, agricultural land in the United States by nationals or entities linked to “foreign countries of concern” (as defined in 15 CFR § 231.102) and other foreign adversaries. The countries currently listed as foreign countries of concern are China, the Islamic Republic of Iran, the Democratic People’s Republic of Korea and the Russian Federation;

  • Tightening investment screening through a signed memorandum of understanding between the Department of Agriculture and the Chair of the Committee on Foreign Investment in the United States, formalising the Department’s participation in and information-sharing on reviews of agriculture-related transactions (including land, biotechnology and activities such as transport, storage and processing); and

  • Modernising the Agricultural Foreign Investment Disclosure Act of 1978, which requires foreign persons who acquire, transfer or hold interests in agricultural land in the United States to report such holdings to the Department of Agriculture within 90 days. The plan directs the Department to implement an online, geospatial filing system with more timely public disclosure, higher civil penalties for late or false reporting, and a public portal for flagging suspected non-compliance or adversarial foreign influence.
