Simplifies procedures under the Mining Investment Law

On 7 July 2025, Decree No. 449/2025 was published in the Official Gazette of Argentina, amending Mining Investment Law No. 24.196 and the Law on the Creation of the Geological Information Database No. 24.466. The amendments aims to simplify administrative procedures, reduce unnecessary bureaucratic burdens, improve regulatory efficiency, and reallocate institutional responsibilities to enhance the effectiveness and transparency of public management in the mining sector. Key changes include the following:

  • Simplified fiscal stability certificate: Under Law No. 24.196, the fiscal stability certificate will no longer list taxes, contributions or fees by jurisdiction. Instead, it will only indicate the date on which the feasibility study was submitted. This date will serve as the sole reference point for determining the applicable tax burden for the purpose of fiscal stability, thereby eliminating delays caused by the late provision of tax information from provincial or municipal authorities.

  • Compliance assessed through cross-checks: Authorities will verify compliance by cross-referencing the investment plans submitted under article 25 with the actual investments declared in the sworn statement for the corresponding fiscal year.

  • Technically reinforced sworn investment statement: The annual sworn statement must now be accompanied by a report prepared by an independent technical professional. This requirement aims to enhance data reliability and potentially reduce follow-up audits and administrative delays for compliant investors.

  • Transfer of geological database administration: The administration of the National Geological Information Bank, established under Law No. 24.466, has been transferred from the Secretariat of Mining to the Argentine Geological Mining Service (SEGEMAR). This change does not affect obligations related to data submission or public access to geological information.
