Known investment treaty cases climb to over 1,300

UNCTAD has updated its Investment Dispute Settlement Navigator. The ISDS Navigator is now up-to-date as of 31 July 2023.

The ISDS Navigator update covers new cases, awards and arbitrator appointments compiled on the basis of public sources and specialized reporting services.

Key findings of the update

During the first seven months of 2023, claimants brought at least 35 known investor-State dispute settlement (ISDS) cases pursuant to international investment agreements (IIAs).

Additional cases have surfaced for previous years and the numbers were adjusted accordingly.

As of 31 July 2023, the total number of known investment treaty arbitrations had reached 1,303.

As some arbitrations can be kept fully confidential, the actual number of disputes filed is likely to be higher.
