Investment Laws Navigator
The Investment Laws Navigator is a comprehensive and regularly updated collection of national investment laws. It contains the full text of the laws and offers user-friendly tools for searching and filtering for selected provisions that are specifically relevant to foreign investors. The Navigator is designed to provide accurate and authoritative information and all laws are identified through a systematic review of government and business intelligence sources and verified to the fullest extent possible.
Through its monitoring and analysis of investment laws, UNCTAD is uniquely placed to contribute to the international investment policy discourse and to provide advisory services and technical assistance to countries interested in reviewing or reforming their regulatory framework for foreign investment.
The database of national investment laws is maintained by UNCTAD’s Investment Policy Research Section. For more information about the database or our advisory services, please contact us via our online contact form.

All laws are available in full text and (re-)formatted to provide – as far as possible – a coherent style across all laws. In this regard, please note:-

Het VLAAMS PARLEMENT heeft aangenomen en Wij, REGERING, bekrachtigen hetgeen volgt: Bestuursdecreet

HOOFDSTUK 2. - Deugdelijk bestuur

Afdeling 5. - Vrijwaring van de strategische belangen van de Vlaamse Gemeenschap en het Vlaamse Gewest
Art. III.59.
Deze afdeling is van toepassing op de volgende overheidsinstanties:
1° de Vlaamse overheid, met uitzondering van het Vlaams Parlement, zijn diensten en de instellingen die aan het Vlaams Parlement verbonden zijn;
2° de lokale overheden;
3° de instellingen die niet onder punt 1° of 2° vallen, maar die voldoen aan al de volgende kenmerken:
a) ze zijn opgericht met het specifieke doel te voorzien in behoeften van algemeen belang;
b) ze bezitten rechtspersoonlijkheid;
c) 1) ofwel worden ze voor meer dan de helft gefinancierd door een instantie die onder het toepassingsgebied van deze afdeling valt;
2) ofwel heeft een instantie die onder het toepassingsgebied van deze afdeling valt meer dan de helft van de stemmen in de raad van bestuur;
3) ofwel staat hun beheer onder het toezicht van een instantie die onder het toepassingsgebied van deze afdeling valt.
Art. III.60.
Als een rechtshandeling van een overheidsinstantie als vermeld in artikel III.59, tot gevolg heeft dat buitenlandse natuurlijke personen of rechtspersonen zeggenschap of beslissingsmacht krijgen in die overheidsinstantie, en als daardoor de strategische belangen van de Vlaamse Gemeenschap of het Vlaamse Gewest bedreigd worden, met name als de continuïteit van vitale processen in het gedrang komt, als bepaalde strategische of gevoelige kennis in buitenlandse handen dreigt te vallen of als de strategische onafhankelijkheid van de Vlaamse Gemeenschap of het Vlaamse Gewest in het gedrang komt, kan de Vlaamse Regering die rechtshandeling nietig verklaren of buiten toepassing verklaren. De Vlaamse Regering kan alleen toepassing maken van het eerste lid als ze kan aantonen dat ze gepoogd heeft de vrijwaring van de strategische belangen te realiseren met instemming van de betrokken overheidsinstantie.

HOOFDSTUK 87. - Inwerkingtreding
Art. IV.277.
Dit decreet treedt in werking op 1 januari 2019, met uitzondering van:
1° artikel II.7, II.19, II.22 en II.23 die in werking treden op de tiende dag na de bekendmaking van dit decreet in het Belgisch Staatsblad;
2° artikel II.16 en II.17 die uitwerking hebben op 23 september 2018.
Kondigen dit decreet af, bevelen dat het in het Belgisch Staatsblad zal worden bekendgemaakt.
