Establish a legal framework for offshore wind development and grid integration

On 10 January 2025, Law No. 15.097/2025 entered into force, upgrading and expanding the framework previously introduced by Decree No. 10.946/2022 for allocating rights to use federal offshore areas—referred to as “prisms”—for offshore electricity generation. The law maintains two award routes: (i) a permanent-offer route, granted by authorization; and (ii) a planned-offer route, granted by concession through competitive bidding.

The law also amends Law No. 10.438/2002 to formally integrate offshore generation into transmission planning and auctions for connection to the national electricity grid.

In addition, the act introduces binding procedural rules for the permanent-offer route, clearly separates offshore-area rights from generation authorizations, and establishes baseline obligations and payment terms associated with the offshore-area grant.
