Raises survey exemption threshold for the Survey of New Foreign Direct Investment

On 3 October 2025, the Bureau of Economic Analysis of the Department of Commerce of the United States put into effect a final rule amending title 15 of the Code of Federal Regulations § 801.7, revising reporting requirements for the BE-13 Survey of New Foreign Direct Investment in the United States.

The rule raises the threshold for the BE-13 Claim for Exemption from $3 million to $40 million and adds a question on the total cost of the acquisition, establishment or expansion. Its stated objective is to reduce respondent burden, simplify reporting and improve the efficiency of data collection.
