Strengthens oversight over investments involving National Core Technologies

On 22 July 2025, amendments to the Act and the Decree on the Prevention of Divulgence and Protection of Industrial Technology entered into force, enhancing oversight of transactions involving entities holding National Core Technologies (NCTs). NCTs refer to protected technologies whose leakage abroad is expected to cause serious harm to national security or industrial competitiveness. They include specific technologies relevant to the following industries: SemiconductorsDisplaysElectrical and Electronics, Automobiles and railwaysMetal, Ship-building, Nuclear powerInformation and CommunicationSpaceBiotechnologyMachinesRobots and Hydrogen.

The amendments authorize the Ministry of Trade, Industry and Energy (MOTIE) to intervene when acquisitions occur without prior approval or reporting and to issue suspension or restoration orders as well as administrative enforcement fines. They also introduce ex officio reviews, allowing MOTIE to determine a company’s NCT status without a prior application.
