Introduces new tax credit programme for qualifying investment activities

On 1 July 2025, the Bahamas enacted the Business Development Incentives Programme Act, 2025, establishing the Business Development Incentives Programme to provide financial incentives to eligible business licence holders. Eligible licence holders are defined as licensees with an annual turnover exceeding $50 million. The Programme aims to encourage investment activities that contribute to economic development and enhance the global competitiveness of the Bahamas as a business hub.

Under the Programme, an eligible licensee may apply for an incentive linked to qualifying activities, including capital investment in plant or equipment; job creation; employee training; the location of senior management and decision-making functions in the Bahamas, including the relocation of senior expertise; increased sourcing from Bahamian suppliers; research and innovation activities; the commercialization of Bahamian artistic or cultural products; and decarbonization or greenhouse gas reduction measures.

Incentives are awarded in the form of credits that may be used to offset tax payable under the Business Licence Act, 2023, or the Domestic Minimum Top-Up Tax Act, 2024, in respect of liabilities arising within the four-year period following the credit date. Recipients are required to maintain records and may be subject to audit, repayment and public reporting to Parliament.
