Amends Special Economic Zones framework to expand eligibility and strengthen incentives

On 27 December 2024, the Business Laws (Amendment) Act, 2024 entered into force introducing changes to Special Economic Zones (SEZ) framework of Kenya. The amendment reformed the incentives provided for SEZ in favour of tax benefits at a fixed 10-year period from the date of license issuance.  This replaces the previous "graduated" framework where some benefits could last up to 25 years. It helps to secure the benefits, without further review procedures.

The amendment also expanded businesses eligible for operation in SEZ with full benefit of the incentives to include:

  • Digital financial services & fintech
  • Information Communication Technology (ICT) services
  • educational zones and research activities
  • designated tourism and resort-focused zones.
  • Professional Services, including consultancy, management, and training services.
  • Administrative and regional management headquarters
  • Broder definition of Business Process Outsourcing (BPO) to include delegating IT-intensive processes to external providers.

The amendments introduce new powers for the Special Economic Zones Authority to set minimum investment thresholds and issue service permits and establish a one-stop shop for approvals and licensing. The reforms clarify the treatment of goods sold within customs-controlled SEZ areas, allow public entities to qualify as SEZ developers.
