ISDS Navigator update: 1190 known investment treaty cases by 31 December 2021

UNCTAD has updated its Investment Dispute Settlement Navigator. The ISDS Navigator is now up-to-date as of 31 December 2021.

The ISDS Navigator update covers new cases, awards and arbitrator appointments compiled on the basis of public sources and specialized reporting services.

Key findings of the update:

  • In 2021, investors brought 68 publicly known investor-State dispute settlement (ISDS) cases pursuant to international investment agreements (IIAs).
  • As of 31 December 2021, the total number of known treaty-based ISDS arbitrations had reached 1,190.
  • To date, 130 countries and one economic grouping are known to have been respondents to one or more ISDS claims. Five countries – Cambodia, the Republic of the Congo, Finland, Malta and the Netherlands – faced their first known ISDS claims in 2021.

As some arbitrations can be kept fully confidential, the actual number of disputes filed in 2021 and previous years is likely to be higher.
