Amends its FDI screening regime

On 29 November 2023, the Government of Romania introduced amendments to its FDI screening regime through the Emergency Ordinance No. 108/2023.

The amendments expands the scope of the screening mechanism, which now encompasses below-control investments where an investor attains "effective participation in the management" of the target. Additionally, a new filing fee of 10 000 Euros has been implemented.

They also clarify that European Union (EU) investors, including Romanian investors, fall under the scope of the FDI screening regime, and introduce a fast-track procedure for Romanian and other investors from the European Union.

The Ordinance was published in the Official Gazette on 6 December 2023.
